Two statutory instruments, the NHS Commissioning Board Authority (Establishment and Constitution) Order 2011 SI No. 2237 and the NHS Commissioning Board Authority Regulations 2011 SI No. 2250, create the NHS Commissioning Board as a Special Health Authority and provide for its membership and procedures. Both come into force on 31st October 2011.

NMS and new MUR Directions published

NHS Directions, the Pharmaceutical Services (Advanced and Enhanced Services) (England) Directions 2011 come into force on the 1st October 2011. They include provisions for the New Medicines Service (NMS) and modified provisions for Medication Use Reviews (MURs) to be targeted at specific groups of patients.

Consultation on extended independent prescribing

The DH has published consultations on extending independent prescribing to physiotherapists and podiatrists. A number of options are proposed, including extending authority to mix licensed medicines prior to administartion and prescribing independently from a limited list of controlled drugs. Both consultations close on 8th December 2011.

Amended NHS contract regulations

Coming into force on 1st October 2011, new NHS (Pharmaceutical Services) Amendment regulations 2011 SI no. 2136 add new definitions of “advanced services” and “registered pharmacy technician” both reflecting current practice; also add further obligations to reach an acceptable system of clinical governance. The regulations apply to England only.

Consultation on RPS regulations to admit scientists

The RPS has published a consultation amending their regulations to admit pharmaceutical scientists. Essentially the changes are to admit “applicants holding, at least, a bachelor degree (or its equivalent), in a subject relevant to the pharmaceutical sciences, and working in the basic or applied sciences, or the social sciences, impinging on the discovery, development, delivery, quality, safety, efficacy, regulation or usage of medicines and their educational development in all its many aspects” and allow them to use the letters SRPharmS. Consultation on changes to MDA regs

The Home Office has published a consultation on proposals to amend the 2001 regulations made under the Misuse of Drugs Act. The document also covers proposals
not to implement (at least yet) two outstanding Shipman Inquiry recommendations: standardised requisition forms for all health professionals and a mandatory requirement to keep a running balance in the CD register. Consultation closes 28th October 2011

DH response to value based pricing consultation

The DH has published its response to the consultation on value based pricing. The next step is essentially to devise a system to define what represents value. Value based pricing is intended to replace the Pharmaceutical Price Regulation Scheme (PPRS) when the current arrangements expire at the end of 2013

Consultation on EU guidelines on medicines distribution

The European Commission has issued a consultation on guidelines on medicines distribution. These aim to take account of the amendments in Directive 2011/62/EU to substantive Directive 2001/83/EC, including arrangements to prevent the entry into the legal supply chain of “fasified medicinal products”. Consultation closes on 31st December 2011 with a view to implementation 6 months after publication of final guidelines

Consultation on strengthened CQC powers

The DH has issued a consultation on changes to the regulations underpinning the activity of the Care Quality Commission. These are said to be: “streamlining and reducing burden of regulation, addressing some practical isssues in the operation of the CQC registration system, correcting drafting oversights and balancing the burden of registration with the risks to those receiving care”. Vision for NHS Commissioning Board

A vision for the role, orgnisation, structure and operating process for the proposed NHS Commissioning Board has been published by the DH. Subject to the passage of the amended Health and Social Care Bill (see June postings), the NHS CB should be established from October 2012 and fully operational by April 2013.
