Direct to Consumer Advertising

Consultation (MLX 358) opens on European Commission proposals on information to patients for prescription medicines (direct to consumer advertising). These aim to “provide for a clear framework for provision of non-promotional information by marketing authorisation holders about their prescription-only medicines to the general public with a view to enhancing the rational use of medicines, while ensuring that the legislative framework continues to prohibit direct-to-consumer”. Consultation closes on 14th August 2009.

Statutory Register for Pharmacy Technicians

New law: The Healthcare and Associated Professions (Miscellaneous Amendments and Practitioner Psychologists) Order 2009 (SI No 1182) provides power for the RPSGB to establish a statutory register for pharmacy technicians from 1st July 2009. There will be a 2 year “window” for voluntary registration at which time (1st July 2011) registration will be compulsory and the title “pharmacy technician” will become restricted.

Pandemic Emergency Regulations (Supply)

New law (also made, laid and in force within 3 days!): The Medicines for Human Use (Prescribing) (Miscellaneous Amendments) Order 2009 (SI No 1165) extends emergency supply arrangements for POMs (not CDs) to up to 30 treatment days; also adds dentists to both categories of emergency supply exemptions and removes the need to interview patient when supplying against a PGD in the event of a pandemic .

Pandemic Emergency Regulations (Licensing)

New law (made, laid and in force within 3 days!): The Medicines for Human Use (Miscellaneous Amendments) Regulations 2009 (SI No 1164) provides certain exemptions from the full requirements of labelling, clinical trials, manufacturing and wholesaling of medicines in the event of a pandemic or other emergencies .

CQC Powers to Regulate Healthcare Premises

New law: The Health and Social Care Act 2008 (Registration of Regulated Activities) Regulations 2009 (SI No 660) prescribes the activities that are to be regulated by the Care Quality Commission in England . These are broadly healthcare services provided by NHS Trusts, PCTs or other Trusts and would include pharmacy services. However, the Order excludes services commissioned by the trust but provided by a third party – which would seem to exclude community pharmacy contractors.

Responsible Pharmacist Toolkit

Standards and Guidance on the Responsible Pharmacist requirements published by RPSGB and a Toolkit sent to all pharmacists

The requirements will come into force on 1st October 2009 along with consequent amendments to Standards and Guidance for Pharmacists and Pharmacy Technicians in Positions of Authority
