Consultation on Pharmacy Wholesaling

As part of the overall review of the UK medicines supply chain, a consultation from the MHRA (MLX 365) sets out proposals to strengthen controls throughout the legitimate supply chain. This will have implications for (amongst others) holders of wholesale dealer’s licences, import for export, community and hospital pharmacy. The current limited exemption for pharmacies will be further restricted to occasional, not for profit supply of small quantities of medicines to meet individual patient’s needs. Consultation closes 12th March 2010

Requirements for CQC Registration Published

New law introduces further requirements for registration with the Care Quality Commission (CQC) for all providers of health and adult social care in England. Due to come into force on 1st April 2010.

More Powers for Non-medical Prescribers

New law allows pharmacist and nurse independent prescribers to mix medicines (or authorise their mixing) in certain circumstances and to prescribe unlicensed medicines. Supplementary prescribers may also carry out these activities within a clinical management plan.

New rules for supply of appliances

New law makes amendments to the 2005 pharmaceutical services regulations affecting pharmacies or other contractors who supply “specified” appliances such as catheters, incontinence or stoma appliances. Additional services, such as providing appropriate advice, offering a home delivery service and review of treatment on repeat prescriptions, must be carried out when dispensing appliances. Comes into force 1st April 2010

Draft regulations on content of PNAs

PCTS (England) must base future award of NHS community pharmacy contract on Pharmaceutical Needs Assessments (PNAs). Draft regulations and guidance from the DH set out specifications for minimum information and procedures for developing PNAs. Consultation closes on 28th February 2010.

GPhC consults on education procedures

The shadow GPhC has published its proposals for future education procedures and registration criteria. These include new criteria for the pre-registration tutor, the pre-registration year and assessment and revamped procedures for accreditation of the MPharm. The consultation closes on 15th February 2010.

Pharmacy Order 2009 before Parliament

The draft Pharmacy Order 2009 which establishes the GPhC is now before Parliament. It also requires approval by the Privy Council.

Health Act 2009 enacted

The latest Health Act (England only) includes many non-pharmacy powers such as the piloting of personal healthcare budgets, implementing the NHS Constitution and prohibiting the display of cigarettes in shops. For pharmacy it implements the mandatory use of Pharmaceutical Needs Assessments by PCTs to manage control of entry to community NHS contracts and the submission of annual “quality accounts” (both by 2011).

Start of Licence to Practise for Doctors

Relevant sections of amending regulations to the 1983 Medical Act come into force on 16th November 2009. From this date, the GMC is introducing a licence to practise requirement for doctors undertaking any form of medical practice for which UK law requires them to hold GMC registration.Further details are given in an RPSGB Law and Ethics Bulletin.

Information Governance Toolkit for Pharmacy

Pharmacy bodies have published draft requirements for Information Governance for all pharmacy service providers. Details appear on the PSNC and RPSGB websites; individual requirements comprising 18 standards and attainment levels are given on the Connecting for Health website. Consultation closes on 27th November; requirements will apply by 31st March 2010.
